West Virginia Medicare Supplement (Medigap) rules

West Virginia adopted a limited Medigap birthday rule in 2026. It works differently from other states' rules, so read the details carefully.

  • Birthday rule (since June 11, 2026): once a year, during the 60 days starting on the first day of your birthday month, you can replace your Medigap policy with one that has the same or fewer benefits, with no health questions.
  • There are limits: your current policy must have been in force for at least 24 months, and in most cases the new policy must come from the same insurance company or one of its affiliates.
  • Losing Medicaid: people 65 and older who lose Medicaid eligibility have a 63-day guaranteed issue period to buy any Medigap policy, from any insurer.
  • Under 65: we're not aware of a West Virginia law requiring insurers to sell Medigap to people under 65, so availability depends on the insurer.

Everywhere in the U.S., your strongest protection is your Medigap Open Enrollment Period: the 6 months starting when you're 65 or older and enrolled in Part B. During that window, insurers in West Virginia must sell you any Medigap plan they offer, at the same price as someone in good health. Plan G and Plan N are common choices for people new to Medicare. Turning 65 in West Virginia

Your Initial Enrollment Period is the 7 months around your 65th birthday: the 3 months before your birthday month, the month itself and the 3 months after. Sign up in the 3 months before your birthday month so your coverage starts on the first day of the month you turn 65. If you already receive Social Security, you'll be enrolled in Parts A and B automatically. Otherwise, apply through Social Security online, by phone at 1-800-772-1213, or at a local Social Security office in West Virginia.

Key Medicare dates for West Virginia residents
